Counter-Notification Procedure

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include:

Required Information for Counter-Notice

  1. Your Signature: Your physical or electronic signature.
  2. Identification of Material: Identification of the material that has been removed or disabled and the location where the material appeared before removal.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notice.
  5. Contact Information: Your name, address, and telephone number.

Our Response Process

Upon receiving a valid DMCA takedown notice, we will:

  1. Promptly Remove or Disable Access to the allegedly infringing material
  2. Notify the User who posted the material of the removal
  3. Provide a Copy of the takedown notice to the user
  4. Document the Notice for our records

If we receive a valid counter-notification, we may restore the removed material after 10-14 business days unless the copyright owner files a court action seeking a restraining order.

Repeat Infringer Policy

We maintain a policy of terminating, in appropriate circumstances, users who are repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate accounts of users who infringe any intellectual property rights of others.

False Claims Warning

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability. We reserve the right to seek damages from any party that submits a false or bad faith DMCA notice or counter-notification.
